Interesting that UE's lawyer appears to be out there doing damage control. I would have thought that was UE's job, unless the lawyer feels somehow liable for damage inflicted on UE by its action and his advice. See post from Ken Clark in response (last on the page today): http://www.boingboing.net/2...

[...] Universal is demanding that IMSLP enforce EU copyright laws upon the entire world. [...] their case under Canadian law is dubious at best. I'm inclined to agree, though I expect they would have to live with country-specific copyright policies. Legally, I presume (as a non-lawyer) there are so...

Re: cease and desist
it seems that the no-brainer in this situation is to REMOVE ALL COMPOSERS born after 1860[...] --DK-- But all copyright law is based on date of copyright notice (ie date of first publication) and extends during the author's life and past date of death to end of calendar year + something usually 50+...

(My remark from the previous post) [...] Joseph Marx (d.1964) is still under copyright in Canada. Any work that was first published before 1923 is public domain in the US (the vast majority of titles listed above). (Comment) This is a total of 60 works - 180,000 Euros. The Joesph Marx works at IMSL...

[[...] A small point, but 'filtering system' can include manual sorting by a real live person. It is indeed clearly quite impossible to imagine a system that does that automatically, at the present state of the art. I suspect that the manual system that requires a conscious decision by the user is ...

I thought I read somewhere the copyright on a standard publication (assuming authors copyright has expired) is about 25 years from date of copyright notice. In musical scores, we are mostly concerned with the copyright in the intellectual property being the composition, regardless exactly how it is ...

Legal information
For non-lawyers like me, have been reading around IP for interest and thought it might be useful to post some legal background resources: WIPO, esp Berne Convention http://www.wipo.int/treaties/en/ Berne Convention - generally uses +50 years from date of death of auther http://en.wikipedia.org/wiki/...

Blouis, I appreciate the discourse, btw. People don't have to be bullied if they know their rights. One of the issues is that effectively the rights are not concrete in the following sense: If the publisher chose to persue this directly in Canada it may be a quick and relatively affordable dismissa...

[[...] There is nothing to prevent the site going back up minus the UE Artists immediately, except the fear of the site administrator of legal action. That's kind of the point, isn't it? The public domain is a right, yet there is enough room in the legal climate to bully people out of it. People do...

Re: Some interesting links on the case
[...] Claiming copyrights for composers like Mahler who died 1911 is clearly Copyfraud. In Germany an enterprise can sue each other enterprise which is falsely claiming a copyright in scores. A Munich court decision has been quoted at http://de.wikipedia.org/wiki/Rechtsschutz_von_Schriftzeichen#Sch...

Once again, I encourage Feldmahler to fight this. Perhaps the site can be revived, temporarily with obeying UE's requests? I know there are a huge amount of composers to go through, but with a few people working on filtering out the copyrighted ones, it shouldn't take very long. This way, perhaps p...

Blouis79, as others implied, WHY should IMSLP have to respect the death+7p, when it was hosted in Canada where the law is death+50? Again, I cite Dover scores. Stravinsky, for instance, isn't even PD in Canada, much less Austria/Germany, yet anyone online can buy a copy of The Firebird, no matter w...

In Canada where the material is physically hosted, there was no breach. That appears not to be true for one artist - J Marx who apparently died in 1964. Therefore the IMSLP is good to go *immediately* when: A. Works of the UE Artists are removed. B. Some system is in place to prevent addition of co...
