I have just acquired a copy of 6 Lieder Op.1 by Fanny Mendelssohn-Hensel. It appears to be an unedited and un-altered facsimile of an 1846 edition by Bote & Bock (plate no. B. et B. 1046). It is reprinted by Bote & Bock in 1985 and carries a copyright notice to that effect on the first page.

Is this a fake copyright notice and can the work be uploaded (without the notice)? I cannot see anything in the work that would indicate that any changes or editorial work has been done.

The short answer is "yes." If there are no contributions of an original nature by an editor, they have no business making a copyright claim.
