Scores imported from libraries, paywall

At present they are behind the paywall. But some libraries say: you may not use this work for commercial purposes. Even if our paywall is not a very thick one 
aren't we dooing a commercial or semi-commercial use?
Could these scores be exempted from the paywall? In my view this is not a copyright issue because these scores are PD but an ethical one.
