Yes, Ferde Grofé died in 1972, so if you're looking for any of his orchestrations then I'm afraid they're under copyright worldwide.

Though even the piano and two piano versions are copyright in the US. In fact, that piece (and Gershwin in general) is one of the main reasons the US copyright is as it is.
