Legality of copyright claims by "The Orchestra Musician

I have come across with a series called "The Orchestra Musician's CD"

The Orchestra Musician’s CD-ROM Library™

It says that this series contains score that are
"out of copyright (that is, in the public domain) in the United States"

They said scores were "scanned" into pdf files, does it mean that they don't even have the typesetting copyright?

However they subsequently claimed copyrights and that their CDs can only be used for private purposes. So what kind of copyright they claim?

None, there is no copyright on the scores at all. That s copyfraud to claim that. The only way they can get away with it, is if they put their trademarked logo on the piece. If that is the case, all you should have to do is delete the logo, and it is free to post.

If it is like CDSM anyway.
